Welcome to Tifansi (the “Platform”) provided to you by Tifansi Pty Ltd (ABN: 676148940) and is for private, non-commercial use. For purposes of these Terms, “you” and “your” means you as the user of the Services. When we say “we”, “us” or “our” we refer to Tifansi entities and staff.

Instructions, rules and prize information on how to enter, participate and win the competition form part of these terms and conditions.

By registering as a Tifansi user or entering into our competitions you are accepting these terms and conditions. By entering the competition you warrant that you have the right, authority, capacity to enter into the agreement under these Terms and Conditions; and you will use the Website or participate in the Promotions for legitimate purpose and your use of the Website and participation in the Promotions will be in accordance with these Terms and Conditions, the Promotion Terms and Conditions (as applicable) and all applicable laws, rules and regulations. The competition is open worldwide for eligible users except for residents in Excluded Countries, people under the age of 18 or where prohibited by law.

We may amend these terms and conditions from time to time by posting the updated terms and conditions on our website. By continuing to use our website or entering into our competitions after the changes come into effect means that you agree to be bound by the updated terms and conditions.

Entry

Competition entry details and any additional instructions will be posted on the Tifansi website.

To be eligible to win, you will need to be a registered Tifansi user and have provided accurate and true information about yourself or you will not be eligible to claim a prize. Registering as a Tifansi user is easy and requires you to input some basic information about yourself such as your email address. Once you are a registered user, you will be allocated an entry ticket or multiple entry tickets that you can use to enter a competition of your choice. Once you have entered a competition you cannot withdraw your entry.

An alternative method of acquiring entry into competitions is to send a handwritten request Attention: Competition entry and Address: 802 East Dunlap Ave,Phoenix Arizona, 85020, United States of America. The request needs to include the competition you would like to enter and your Tifansi user account name. If we cannot find your name or the letter is not readable we reserve the right to not allocate you a competition entry. We will need to receive your letter at least 5 days before the announced end date of a competition.

The competition must be entered by submitting entry tickets using the online form provided on the Tifansi website and passing the verification requirements (email or fraud score) set by the Sponsor. The entry must fulfil all requirements of the competition, as specified, to be eligible to win a prize. Entries that are incomplete or do not adhere to the rules or specifications of the competition may be disqualified at our sole discretion. You must provide the information requested. You may not enter more times than indicated in the rules by using multiple email addresses, identities, or devices in an attempt to circumvent the rules. If you use fraudulent methods or otherwise attempt to circumvent the rules of the competition, your submission may be disqualified at our sole discretion.

The winning entries will be drawn randomly by computer on the date and at the time specified on Tifansi website for that competition. To enter the competition you need to be a resident of an eligible country and be 18 years of age or older.

Employees, management or board members (advisory and executive) and members of their immediate families, relatives of Tifansi or anyone directly engaged in conducting the draw for the competition and members of their Immediate families and/or Relatives are not eligible to participate.

The competition period, draw dates, additional rules (if applicable() as well as prize information and values will be displayed on the Tifansi website.

Prize winners

If your ticket has been chosen as the winning ticket you will be notified within 7 days of the draw to the email address specified by you when you created your Tifansi account. You will have 7 days to accept by completing the Winners form that we will provide. The form will require you to enter information such as your name, your contact details and address, validate your email address, your age and domicile where you reside. We will use this information to validate you are the winner, of legal age and reside in an eligible country. We will also use this information to contact you to coordinate receiving of the prize and any associated promotional activities.

You may need to submit a copy of your government issued identification so we can verify your identity, proof of age and eligibility. We promise to treat your information securely and with utmost confidentiality. We will delete your documents once we no longer need them for the purpose of providing you the prize.

Should the selected winner not confirm acceptance or complete the Winners form accurately during such term and provide adequate documentation, the winner waives the prize.

Once we have validated your eligibility you will be sent a confirmation email with details of the prizes and in particular the terms of their attribution and use. Once the winner has completed the Winners form, accepted the associated Winners Terms & Conditions and we have validated the winners eligibility, we will publish the winners name on our website.

We will communicate with the winner to coordinate delivery or pick up of prizes in your region. The prizes may be provided and delivered directly to the winners by third parties. In such a case, Tifansi will not be responsible for the provision and delivery of the prizes and the winner may have to bear delivery costs. The winner will be duly informed of the delivery location and any associated cost if to be borne by the winner. We will use our best efforts to get the prize to you in a timely manner. Delivery times will vary depending on the prize and your location.

Prizes will only be attributed, complying with all applicable laws, to winners with legal residence/domicile in any given territory where the prize can be legally delivered.

If a prize is not available for any reason, Tifansi, at its sole discretion, reserves the right to substitute a prize that is similar to the unavailable prize and of the same or greater value. Prizes are not transferable or assignable to another person, or redeemable for cash.

Photographs or images of prizes are for illustration purposes only and may not depict exact prize detail. All other costs associated with the prizes which are not expressly stated to be included, including insurance, duties, and taxes, are the responsibility of the winners. Tax regulation of the prizes will be according to the applicable law. Any tax burden (including customs duties and clearance) that the acceptance of the prize may involve shall be borne by the winners according to their tax domicile.

Tifansi reserves the right, at any time, and in its sole discretion to:

request players to provide proof of identity, age and residency and/or proof of valid entry;
verify the validity of an entry; or
disqualify any player who Tifansi has reason to believe has breached any of these terms and conditions or engaged in any unlawful or other improper conduct or any conduct calculated to jeopardise the fair and proper conduct of the competition.

Please be aware as you create your username that Tifansi reserves the right to refuse accepting the application of usernames that we consider to be inappropriate or offensive. Such usernames will be deleted, and the account will appear under a default name chosen by Tifansi.

Tifansi will at its sole discretion accept or refuse any entry into our competitions. If we consider that the entry does not comply with our terms, rules and regulations the entry will be disqualified and the affected user will be notified by email.

Third party terms and conditions may apply to certain parts of a prize, where applicable. For example, where the prize contains ticket(s) to an event, you and any guest(s) and/or travel companion(s) will not only be bound by the Tifansi terms and conditions, but also the event organizer and venue owner’s rules and all terms and conditions set out on the ticket.

Unless otherwise specified in the competition rules on the Tifansi website, there is only one winner per competition.

In order to give all our users the chance to win, unless otherwise stated in the competition rules, winners of prizes of US$1,000 or above are not eligible to win another prize for the subsequent three(3) months of winning. If you win multiple contests at the same time, you will have the choice of your preferred prize.

Tifansi is not responsible for late, lost or misdirected entries. Tifansi is not responsible for any problems or technical malfunction of any computer system, software, network or Internet difficulties, including any damage to a player's computer, resulting from participation in the competition. Any cost associated with accessing or submitting an entry is the player's responsibility. Tifansi cannot guarantee entry for (and accept no responsibility for) entries that are mis-spelt, corrupt or ineligible, or entries that have not reached us due to network incompatibility, technical faults or for any other reason. Entries received outside of the opening and closing times of the Promotion will not be accepted.

Tifansi makes no representations or warranties as to the quality, suitability or merchantability of any goods or services offered as part of the competition. Tifansi will not be liable for any loss or damage or personal injury suffered or sustained in relation to the competition or a prize except for any liability which cannot be excluded by law.

If Tifansi is prevented from or delayed in performing an obligation by Force Majeure then the obligation is suspended during, but for no longer than, the period the Force Majeure continues and any further period that is reasonable in the circumstances. "Force Majeure" means an event beyond the reasonable control of Tifansi, which occurs without the fault or negligence of Tifansi.

If for any reason this competition is not capable of running as planned, including but not limited to tampering, unauthorised intervention, fraud, any technical difficulties or equipment malfunction or any causes beyond the control of Tifansi, which corrupt or affect the administration, security, fairness or integrity or proper conduct of this competition,Tifansi reserves the right in its sole discretion to take any action that may be available, and to cancel, terminate, modify or suspend the competition, subject to state regulation.

Any product or brand names, logos, images and other trademarks featured or referred to within these terms or conditions or on Tifansi's website are the property of their respective trademark owners. Unless otherwise indicated, these trademark owners are not affiliated with Tifansi and do not sponsor, approve or endorse Tifansi.

Tifani has the right to use the photographs (if any), username, names or nickname, country and results of winners at its sole discretion for publicity purposes. Tifansi may publish the data mentioned on our platform and on any other third party authorized sites included but not limited to , , x.com, , newsletters etc.

Accordingly, by participating in the Tifansi competition, each user explicitly agrees to the use and publication of his/her name and image, if available a photo, on winning a prize, if this is required by Tifansi.

ADDITIONAL TERMS RELATING TO PRIZES INVOLVING ATTENDING EVENTS

Prizes involving Events ("Event Prizes") are subject to availability and must be taken in accordance with all requirements specified by us, including but not limited to requirements around dates, destinations, carriers and number of passengers. Blackout periods may apply, including public holidays either in the UK or the destination country.

Unless the Specific Rules state otherwise, you will be responsible for all ancillary expenses in relation to the prize which are not expressly included. The cost of food, drinks, taxis/transfers, gratuities, government taxes (where applicable), any additional luggage allowance and so on will not be included unless they are expressly included in the prize description. You must ensure that you have sufficient financial resources to meet any financial commitments which you may incur in connection with the prize beyond those which are included as part of the prize (including but not limited to transfers to and from the UK airport, meals and drinks). You must not commit us to any costs or expenses without our prior written consent (which we are not obliged to give) and will remain liable for such costs if you attempt to do so.

You will be responsible for all necessary inoculation and all other health and/or visa requirements for your holiday destination.

You must hold a valid passport (which will not expire within 6 months after the last day of the Event) with no visa restrictions. Passport control and in-country authorities reserve the right to refuse entry and/or to detain you, for example, some countries may deny you entry if you have a criminal conviction. If you are refused passage and or entry/exit to or from the country being visited, we will not be held responsible for that or for any costs, expenses or losses incurred by you or your guest(s)/travel companion(s), which will be your sole responsibility. If you are not able to travel, your guest(s)/travel companion(s) may also be denied access to the Event Prize.

All Event Prizes must be taken within the timeframe specified in the Specific Rules (unless otherwise stated in the Specific Rules or agreed with us). If Event Prizes are not taken by this date, unless we agree otherwise, you will forfeit your right to the prize and we reserve the right to withdraw the prize and select another winner.

Event Prizes are not available to persons under the age of 18 unless otherwise stated in the Specific Rules. If permitted to travel, children under 18 years may only do so if accompanied by a parent or guardian (or, if we agree on a case by case basis, another responsible adult) aged 18 or over.

If insurance is offered as part of the prize, the Specific Rules will provide details of any travel insurance policy or we may provide these to you separately. Where no insurance is expressly offered, or you do not consider the insurance to be adequate for your needs, you are responsible for obtaining adequate travel insurance.

You must comply with all lawful instructions and terms and conditions, including but not limited to health and safety requirements and instructions that are set by us, the prize provider, the airline and other carriers, organizers, venues, partners and providers involved in the Promotion and/or the prize.

Your guest(s)/travel companion(s) must also meet our eligibility criteria, namely that they are not excluded from entering into our Promotions due to any of the requirements as set out in the Promotion Terms and Conditions.

Where a prize involves attendance at or tickets to an event, you acknowledge that we are not liable or responsible if you fail to attend the event for any reason. If the event is cancelled or rescheduled, we will either secure tickets for the winner to attend the rescheduled event if practical (the date and time will be decided solely between us and the prize provider) or, at our discretion, provide an alternative prize.

Where a prize involves an event, you acknowledge that this prize is subject to the terms and conditions of the venue, the promoter and the ticket agent and you must comply with all such terms and conditions, including but not limited to any relevant instructions and health and safety requirements.

19. Privacy

Tifansi respects each individual it deals with and this extends to respecting and protecting personal information. To the extent that the Privacy Act 1988 (Cth) (Privacy Act), and the Australian Privacy Principles (APPs) governs the way in which Tifansi must manage personal information, the purpose of this statement is to advise you that by entering the competition, you consent to Tifansi collecting, using and disclosing, in accordance with Tifansi's privacy policy, various personal information about you, including your name, address, phone number, and email address.

The personal information of a subscriber will be collected by way of the competition entry form or user account information.

This collection is for the purposes of conducting the competition, locating, verifying, and publishing prize winners, facilitating Tifansi's internal business operations, including internal record keeping and the fulfilment of any legal requirements under applicable laws, analysing Tifansi's goods and services and customer needs with a view to developing new or improved goods and services, providing you with information about Tifansi and the goods and services that Tifansi, or its related entities or organisations that Tifansi has affiliations with, offer that may be of interest to you, and any purpose directly related to any of the above.

If you do not provide the personal information requested, or if the personal information you provide to us is incomplete or inaccurate, Tifansi may not be able to process your entry into the competition or to contact/locate you for delivery of the prize, and Tifansi may be unable to provide you with the information you are seeking.

In order to provide goods and services to you, Tifansi may from time to time disclose your personal information to its employees, contractors, and related and affiliated entities for the purpose of providing its services, operating Tifansi's business, and fulfilling your requests, service providers who assist Tifansi in operating its business (including cloud data storage suppliers, IT suppliers, mail distribution service suppliers, marketing service providers, market research companies, or professional advisors such as lawyers, accountants, and auditors), and any other entity as required or authorised by law (including law enforcement bodies, relevant authorities, and charitable sector or gaming regulators).

More detailed information about the way Tifansi uses, discloses and secures your personal information, how you can access and correct that information, and how you can make a complaint about a breach of APPs can be found in Tifansi’s Privacy Policy, available by contacting Tifansi via our Help Centre or on privacy@tifansi.com.

The laws of Victoria apply to the competition and these terms and conditions. Players irrevocably submit to the non-exclusive jurisdiction of the Victoria courts in connection with the competition. Some of the terms in the agreement survive termination or expiry of the competition.

Definitions

“Competition” means the game of chance or game of skill that is available for entry to eligible users on the Tifansi platform.
"Gift Recipient" means a person who is at least 18 years of age and named as the player in a competition where another person has purchased the ticket for them as their agent.
"Immediate Family" means a person's spouse and any close family members
"Player" means the person whose name is identified in the user account the subscription prior to the commencement of the competition.
"Relatives" means a close family member connected by blood, marriage or adoption including de facto partners, but not extending beyond the Immediate family.
“Winner” is the user whose ticket is selected as the winning ticket in a competition.
“Excluded Countries” are countries or former countries are not eligible to participate in Tifansi or our competitions: Democratic People’s Republic of Korea, Cuba, Iran, Libya, Syria, Former Federal Republic of Yugoslavia, Myanmar, Ukraine (Crimea, Donetsk, and Luhansk Regions), Zimbabwe, Central African Republic, Balkans, Belarus, Burundi, Central African Republic, Mali, Democratic Republic of the Congo, Guinea-Bissau, Iraq, Venezuela, Lebanon, Somalia, Yemen, South Sudan and Sudan.
“Event” means any scheduled occurrence for which tickets or access is provided as part of the prize package, and which is subject to the terms and conditions of the venue, promoter, and ticket agent.

“Time” and all references to time in these terms and conditions are a reference to Australian Eastern Standard Time ("AEST").
